MANDATE AND OPERATIONS

Mandate: Established by President Mugabe to investigate the government repression of “dissidents” in the Matabeleland region of the country during 1983.

Staff: Headed by Zimbabwean Lawyer

FINAL REPORT

Report kept confidential on the grounds that it could spark violence over past wrongs.

Much controversy was created over confidentiality, leading to the production of a report in 1997 by two Zimbabwean Human rights organizations, Catholic Commission for Peace and Justice in Zimbabwe and the Legal Resources Foundation, titled “Breaking the Silence, Building the Peace.”  [PH]

LATEST UPDATE

October 2007: In 2003, a group of Canadian and Zimbabwean lawyers filed to the Canadian justice minister a draft indictment asking him to charge Robert Mugabe under the Canadian Crimes Against Humanity and War Crimes Act. Evidence and sworn statements are to be gathered in Zimbabwe. President Mugabe however still hold immunity as head of state. [global policy]

In November 2006, Canadian Justice Minister Vic Toews quashed the attempt by a parliamentary committee to indict Mugabe for crimes against humanity.  The bases for this move were Mugabe’s head-of-state immunity and the absence of a link between Canada and the victims of offences. [voa news]
