MANDATE AND OPERATIONS

Proposed Mandate: To investigate brutal tactics of the Kenyan African National Union (KANU) under former President Daniel arap Moi from Kenya’s independence (1963) to December 2002.

Recommended in August 2003,by Kenyan Task Force on the Establishment of a Truth, Justice and Reconciliation Commission, which indicated 90% of Kenyans wanted such a commission.

Update October 2007: On June 5, 2004, participants at a three-day conference expressed concern that the government was not taking the creation of a truth commission seriously. They resolved to form a committee to present guidelines to the government within the next six weeks. [The Eastern African Standard] So far, the recommendations have been ignored by the government. Early in 2006, the Kenya Human Rights Commission and the Mau Mau War Veterans Association were preparing to file a suit in the British courts to hold the British government responsible for reparations for atrocities committed against the Mau Mau during its colonial rule. The British government has refused to accept responsibility for the atrocities, and has stated that it will no pay the compensation demanded. Lawyers representing the Kenya Human Rights Commission stated in 2006 that they would give Whitehall until March 2007 before filing a case before the High Court, but they have yet to act accordingly.
